Update: Senate Sets Conditions for Senator Natasha Akpoti-Uduaghan’s Return Following Court Ruling

The Nigerian Senate has outlined conditions for the possible reinstatement of Senator Natasha Akpoti-Uduaghan, following a Federal High Court judgment that declared her six-month suspension unlawful.

Justice Binta Nyako, delivering judgment on Friday in Abuja, faulted the Senate’s decision to suspend the Kogi Central lawmaker for 180 legislative days, describing it as excessive and a violation of her constituents’ right to representation.

Akpoti-Uduaghan, who represents the Peoples Democratic Party (PDP), was suspended in March 2025 for alleged gross misconduct, after a confrontation with Senate President Godswill Akpabio over seating arrangements. The issue escalated when she publicly accused Akpabio of retaliating against her for rejecting his alleged sexual advances—an allegation the Senate President has denied.

Challenging her suspension in suit FHC/ABJ/CS/384/2025, Akpoti-Uduaghan asked the court to overturn the Senate’s decision. Justice Nyako ruled in her favor, stating that while the Senate has disciplinary powers, such sanctions must not deny citizens their right to representation.

“The Senate cannot impose a suspension that effectively disenfranchises an entire constituency. The law does not specify a maximum suspension period, but it must be reasonable and in line with democratic principles,” Nyako stated.

However, the court also found Akpoti-Uduaghan guilty of contempt over a satirical apology she posted on her Facebook page on April 27. The judge ruled that the post was connected to the ongoing legal proceedings and ordered the senator to publicly apologize in two national newspapers and on Facebook within seven days. She was also fined ₦5 million.

Senate’s Reaction

Responding to the judgment, Senate spokesperson Yemi Adaramodu clarified that Akpoti-Uduaghan would not be reinstated immediately. He emphasized that the judgment did not strip the Senate of its constitutional powers to discipline members.

“Yes, the court acknowledged the Senate’s disciplinary powers. The judgment doesn’t override that,” Adaramodu said. “The court has directed her to make restitution, and only after she complies will the Senate reconvene to consider the matter.”

He added that the Senate would assess the “content of her apology” before making a final decision. “The ball is in her court now. Once she fulfills the court’s directives, the Senate will review and determine the next steps.”

Legal Perspective

Senate counsel, Paul Dauda (SAN), described the ruling as a partial victory for the Senate, particularly regarding the contempt ruling.

“The court upheld our position on the improper use of social media during litigation. It ordered the senator to take down the post and issue a formal apology,” Dauda said.

On the issue of reinstatement, he clarified that the court did not issue a direct order. “There was no relief granted to reinstate her. The judge made what we call an obiter dictum—a non-binding remark—that the suspension appeared excessive.”

Atiku Reacts

Former Vice President Atiku Abubakar praised the judgment and commended both the judiciary and Senator Akpoti-Uduaghan.

“I applaud Justice Binta Nyako for courageously lifting the unjust suspension of Senator Akpoti-Uduaghan,” Atiku posted on his official X (formerly Twitter) handle. “I also commend Senator Natasha for standing up for her rights in a chamber where women are often marginalized. No price is too high in the pursuit of justice.”
